Levirate Marriage

If brothers dwell together, and one of them dies without having had a child, the wife of the deceased may not marry outside the family to a stranger. Her husband’s brother must go to her and take her to himself as a wife and perform the duty of a husband’s brother to her. It shall be, that the firstborn whom she bears shall continue in the name of his brother who is deceased, so that his name will not be blotted out of Israel.

If the man does not want to take his brother’s wife, then let his brother’s wife go up to the gate to the elders and say, “My husband’s brother refuses to raise up his brother’s name in Israel. He will not perform the duty of my husband’s brother.” Then the elders of his city shall call him, and speak to him, and if he persists and says, “I do not want to take her,” then his brother’s wife must come to him in the presence of the elders and remove his sandal from his foot, and spit in his face, and answer and say, “So shall it be done to that man who will not build up his brother’s house.” 10 His name will be called in Israel, “The house of him who has his sandal removed.”
